Drafting and Pleading - Sample Leave and Licence Agreement
THIS Agreement of Leave and License, made and executed on this Tuesday of 1.10.2019
BETWEEN
1) Shree Rajesh Deshmukh, Aged about 40 years, Manager, Bank of India , R/o at Bhande Plot, C31, Nagpur, Hereinafter called as Owner and which expression shall always mean and include, unless otherwise repugnant to the context or meaning thereof, his heirs, representative OF THE FIRST PART
AND
2) A) Vijay Bhopale, R/o Ward No 5 Umrer, District Nagpur , 413434
B) Ajay Bhopale R/o Ward No 5, Umrer, District Nagpur, 313434
Hereinafter called as THE LICENSEE, which said term and expression shall always mean and include, unless repugnant to the context or meaning thereof, it's successors, representatives, nominees and all such other persons claiming through or under it OF THE SECOND PART.
3) WHEREAS, this license of Leave and License/ of Rent is in relation to Apartment bearing B 301, covering built up area ad measuring 49.533 sq meter, on the third floor of of the building known as "SHANTIKUNJ" having corporation house number 123/B, Survey Number 145/5 Situated in Mouza Chinchbhavan, Wardha Road, Nagpur, hereinafter for the sake of brevity referred to as the said premises owned and possessed by the owner
WHEREAS, all the licensees in the need of accommodation, all Second Part are studying in IIT Nagpur,
WHEREAS matter was negotiated and it is mutually agreed and decided that the licensee shall pay to the Owner license fee as below
The licensee has deposited Rs 15000 with the owner and the licensee shall deposit the monthly rent of Rs 10000.
NOW THEREFORE IT IS AGREED BY AND BETWEEN THE PARTIES AS FOLLOWS:
- This Leave and License Agreement is made for period of 11 months commencing from 1.10.2019 to 30.9.2020 Including amenities, fixtures and fittings. The licensee shall not allow any other person to occupy or reside in the premise in question. Licensor/Owner shall be deemed to be judicial possessing of the licensed premise and licensee would be in use and occupation there of as licensee.
- That the licensee shall occupy the said premise only for residential purpose
- That the licensee has deposited the licensor/owner interest free security of deposit of Rs 15000 by Cash on 30th September 2019 and licensee shall deposit monthly rent of 10000 Rs every month before 10th of every month in bank account of Owner
- That the licensee shall keep the premise, floors, walls, ceiling, doors, windows, electric installation, water taps, in good repair and condition and shall repair and make good or replace any breakage or damage material or any part thereof.
- That the licensee shall not make or caused to be made, permit or caused to be permit any alteration, addition to the construction arrangement to the premise in question. After the expiry of period of this leave and license agreement , the licensee shall at his cost put the said premise in the same condition as it has been at the time of giving the premise on leave and license.
- That the licensee shall not do or caused to be done or permit the said premise, any act or thing which may become nuisance or annoyance to or in any way interfere with quite possession of the licensee/owner or the occupier of the building in question
- That the party hereto, expressly agree and declare that no tenancy right or any right, title or interest in the nature of tenancy or any other interest whatsoever is hereby created or intended to be created by this agreement the privilege granted is personal one
- That the licensee shall not keep or store in or upon the premises petrol or any other goods of combustible nature, hazardous or of explosive nature. The licensee shall not do or caused to be done on the licensed premise anything, which shall endanger the life of building and inmates thereof
- That the party hereto agree that the license hereby granted to the licensed premise on the personal basis and licensee shall not transfer, assign sub let or under let or grant any license in respect of or part with possessing of licensed premise or any part thereof
- That the Licensor/Owner shall not be responsible for any mishap or danger that may happen to the person or property whatsoever and or his anyone from his side, servants, visitors, invitees using the said premises for the time being or on any account whatsoever
- That the Licensor/Owner shall not retain the original key in respect of the premises.
- That the Licensor/Owner shall inspect the licensed premise only with prior notice or intimation to the licensee
- That the Licensee shall pay maintenance charge for the said Apartment no 410 whichever charged by society or Onwer's association
- That both the parties shall give one month notice for termination of license/rent agreement. On the expiry or earlier termination of this agreement, licensee shall remove all his belonging from the said premises and hand over the vacant and peaceful possession of the said premises to the owner/licensor without any claim or objection.
- That the licensor/owner shall return the security deposit to the licensee at the time of taking over posession
- That the cost of stamp, required for this licensee agreement and the registration and it's renewal charges therefore shall be borne and suffered by the licensee, whenever and as and when the same is required to be incurred and suffered.
- That the rent/license fee shall be increase by 10% every year.
- That the licensor/rent won't have objection to beer drinking by licensee.
