Civil Procedure Code - Application for Execution of Decree

Execution of decree is dealt from Section 36-74 and Order 21.

Rule 10-16 deals with application of execution to a court. You file a suit, you fight a case, you win. Not enough, you have to file for execution of decree also. 

Decree determine rights of parties related to issue in a suit.  For enforcement of that right we have to file another application.

Where to file an application for execution ?

Who can file an Application ?

What should be the content of such application ?

One important thing here is application needs to have a description of mode in which Court assistance needed.

That Court assistance includes below things:

Additional details have to be given when application is for arrest, when application is for movable property not in possession of judgment debtor or immovable property. Those provisions are in Rule 11A, 12,13.

Below is the summary of those provisions:

Execution in case of joint decree or when decree is transferred to other person

When decree is in favor of joint holders, any one among them can file for execution.

Decree can be assigned to other person or it can be transferred by operation of law. In such case decree has to be executed as if transferee is decree holder.
